FCRA amendments seek to make Aadhaar mandatory for NGOs, prohibit funds transfer, says law firm

The Foreign Contribution (Regulation) Amendment Bill, 2020, which was passed in the Lok Sabha on Monday, will make Aadhaar mandatory for all office bearers of non-governmental organisations, who are seeking foreign grants, and restrict transfer of foreign contributions received to other persons, a law firm said on Monday.

Law firm L&L Partners said that the amendments to the Foreign Contribution (Regulation) Act seek to introduce new provisions under Section 12A of the Act. The provisions will require any person or entity, seeking to get registration or have the FCRA licence renewed, to furnish the details of Aadhaar cards of all its office bearers and directors. In case the officials or directors are foreigners, they will have to provide a copy of the passport or Overseas Citizen of India card, the firm said.
