Judge Who Gave Contentious POCSO Judgements Not Made Permanent

Bombay High Court Judge, Justice Pushpa Ganediwala, who was behind various contentious judgements pertaining to the Protection of Children from Sexual Offences (POCSO) Act, will not be appointed as a permanent judge, reported LiveLaw.

Justice Ganediawala is slated to continue as an additional judge for one more year, starting Saturday, 13 February.

According to LiveLaw, the Ministry of Law and Justice accepted the revised recommendation of the Supreme Court collegium to not elevate Justice Ganediawala as a permanent judge of the Bombay High Court, and to allow her to continue as additional judge.

THE CONTENTIOUS JUDGEMENTS

Justice Ganediwala, an additional judge of the Nagpur bench of the Bombay High Court, had come in for serious flak over her acquittals of men under the Protection of Children from Sexual Offences (POCSO) Act, including one where she held that groping a minor without ‘skin-to-skin’ contact shouldn’t be considered sexual assault.
